Twistcode's Civil Suit Against TM Berhad

Twistcode Technologies Sdn Bhd (Twistcode) as one of the local companies specializing in artificial intelligence and supercomputers has filed a lawsuit against Telekom Malaysia Berhad (TM Berhad) and 2 other key officers of TM Berhad in the Kuala Lumpur High Court on 3 January 2024 amounting to RM41.6 million including certain reliefs, with a declaration that TM Berhad has breached and disobeyed the 'Teaming Agreement', Letter of Award and Purchase Order from Twistcode for the purpose of completing the objective of the joint venture to create and advance "Accelerated Artificial Intelligence" (AAI) to provide high-performance computing services for oil and gas industries in Malaysia.

Twistcode suffered economic loss, income, business decline and reputation following a police report made by TM Berhad in June 2020 involving baseless allegations against Twistcode which causing Twistcode to be investigated by the Commercial Crime Investigation Department (CCID) and MACC in July 2020 and March 2021, but with no prosecution on Twistcode to date. TM Berhad did not sign the 'Master Service Agreement' (MSA) even though RM14.1 million had been paid and the MSA had been signed by Twistcode.

TM Berhad denies Twistcode's claim and Twistcode is ready to prove it.

The above action of suing TM Berhad had to be officially announced as all Twistcode's efforts to negotiate a solution between the parties failed.

Therefore, Twistcode hopes that the case will be heard in the Kuala Lumpur High Court on 8th October 2023 and its development can be followed by other local companies, especially startups as a guide and lesson to be learned.
